Josh Duggar Inmate Files Lawsuit Over Alleged Inhumane Prison Conditions and Drug Use

Josh Duggar’s incarceration at FCI Seagoville in Dallas, Texas, has been thrown into the spotlight following a bombshell lawsuit filed by a fellow inmate, alleging a host of disturbing conditions at the federal facility where Duggar is serving his 151-month sentence for child pornography.

The explosive complaint, filed in February 2025 and exclusively revealed by The US Sun, accuses the Federal Bureau of Prisons facility of worsening conditions and rampant drug use.

Mold, Seizures, and Drug Allegations

 

The unnamed inmate claimed he was exposed to synthetic marijuana (K2) upon arrival at the yard and suffered a seizure in January 2025. He claims medical staff were negligent, only checking his vitals.

His lawsuit further alleged: “They have me in this 100-year-old building with mold in these cells and air vents… I keep complaining about it since I had my seizure… and they won’t do anything.”

The court ordered the inmate to refile the complaint on the proper form, but the deadline expired, leading to the case being dismissed without prejudice.

History of Harsh Conditions

 

This is not the first time FCI Seagoville has faced accusations of inhumane treatment. The US Sun previously reported on a February 2024 lawsuit by inmate Wadino Peterson, who alleged:

  • Maggots in the food served at the prison.

  • Being denied medical care for seizures and brain issues.

  • Witnessing raw sewage inside the jail for over 24 hours in November 2023.

Both the current inmate’s and Peterson’s lawsuits were ultimately dismissed.

Inmates Face Medical Neglect and Poor Nutrition

 

An insider has also provided troubling details to The US Sun regarding general inmate welfare, claiming that medical neglect is common. The source alleged that sick calls are often missed, and some inmates wait years for basic care, such as glasses.

Furthermore, the source claimed that inmates are susceptible to illness due to poor living conditions and issues with food quality:

  • Food is “regularly expired,” sometimes by “at least a couple of weeks.”

  • There was a reported “run of cereal that had bugs in it.”

  • Portions are small, and the prison occasionally runs out of food.

Josh Duggar’s “Luxury” Living

 

In stark contrast to the disturbing allegations of mold and neglect, Josh Duggar reportedly resides in special quarters. Sources told The US Sun that Duggar lives in Dorm 6, which has been converted into an “honors dorm” for model inmates. This section reportedly offers:

  • Updated living quarters with fresh paint and even flowers.

  • Special privileges, including washers, dryers, and microwaves.

Duggar’s Continued Appeal Battle

 

Despite his “luxurious” living arrangements, Duggar is still aggressively pursuing his freedom. On May 12th, 2025, The US Sun reported that Duggar filed a request for court-appointed counsel to help him prepare a motion to vacate, set aside, or correct his conviction and sentence (a Section 2255 motion).

Duggar argued he lacks the resources and legal training to properly investigate “complex constitutional and evidentary issues,” including errors in forensic evidence admission and potential Brady violations from his 2021 trial. He stated he is “unable to afford counsel due to my current financial circumstances.”

Duggar has maintained his innocence since his arrest in 2021. His initial appeals were denied by the 8th US Circuit Court of Appeals in 2023 and the Supreme Court in 2024. His expected release date was previously pushed back from October 2, 2032, to December 23, 2032.
